Wage and Hour Violations
Wage and Hour Violations often go hand in hand with unpaid overtime. However, if your employer is asking you to “work off the clock,” it is not only failing to pay overtime, it is also failing to pay your regular hourly wage for work rendered. Requesting non-exempt employees to work without compensation through lunches, breaks, and other hours beyond the 40-hour workweek violates the California Labor Code and the Fair Labor Standards Act (FLSA). There are also regulations protecting employees relating to standby-time, minimum wages, timely payment of wages, and furnishing of pay stubs.
If you have reason to believe wages are being illegally withheld or miscalculated, or that other violations relating to your pay are taking place, an attorney experienced in Employment Law can assist by reviewing your situation and advising the proper course of action.
